Draft
Terms of Service
Effective date:
This is a draft for review. It is not yet in force.
These terms are an agreement between you and FitRats about using the FitRats app and website (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
1. What FitRats is
FitRats is a habit tool for small groups. You set personal goals, report a daily check-in, and the app computes a result for each day (on track, off track or reset) from the goals you chose. Members of the same challenge see each other's results.
FitRats is not a calorie calculator, a food database, a workout planner or a payment service. You supply your own numbers; the app records them and applies the rules you and your group agreed to.
2. Your account
- You must be at least 13 years old to use the Service.
- You sign in with your email (a one-time code), with Apple or with Google. Keep access to that email or account safe; you are responsible for what happens under your account.
- Give us a real name or a name your group recognizes. It is shown to the members of your challenges in standings and in the feed.
- You may delete your account at any time from Settings. Deleting the account removes your personal data as described in the Privacy Policy.
3. Challenges, stakes and fees
A challenge is a private agreement between its members. Its house rules (the stake per slip, the destination of fees, the settlement day, the weekly cap) are chosen by the group when the challenge is created. FitRats computes each member's weekly amount from those rules and from the member's own check-ins, and records the settlement status that members report.
- Fees are agreements between members, not payments to FitRats. FitRats is not a party to them, does not receive, hold, pool, forward or guarantee any money, and does not charge a fee on them.
- Payments are made directly by the member to the destination the group chose, through the member's own bank (for example via Pix). Receipts are reviewed by another member of the group, not by FitRats.
- The destination of fees is fixed for the whole group and is never a prize for a member and never decided by chance. Do not use the Service for betting, lotteries or any arrangement where money is won.
- Disputes about whether a fee is owed, whether a receipt is valid, or whether a member has paid are between the members. FitRats may show the status members reported but cannot enforce payment.
- You are responsible for making sure your challenge's rules are lawful where you live and for any tax or legal consequences of the payments you make or receive.
4. No medical advice
FitRats does not provide medical, nutritional or fitness advice. Goals, thresholds and results in the app are rules you chose for accountability; they are not recommendations for your health. Talk to a qualified professional before changing your diet or exercise, especially if you are pregnant, have a medical condition or a history of disordered eating. Stop using a goal that harms you. FitRats is not responsible for decisions you make based on the app.
5. Your content and your group
- Check-ins, results, photos, weight entries and settlement status you add are visible to the members of your challenges. Do not join a challenge with people you do not want to share them with.
- You keep ownership of what you upload. You give FitRats permission to store, display and process it as needed to run the Service.
- Only upload photos you have the right to share. Do not post content that is unlawful, harassing, or that exposes other members' private information.
- Report your check-ins honestly. FitRats may remove content or accounts that abuse the Service or other members.
6. The Service
- FitRats is provided "as is". We work to keep it available and accurate, but we do not promise uninterrupted service or that results, reminders or notifications will always be delivered on time.
- We may change, suspend or discontinue features. When a change affects how days are judged or how fees are computed, we will tell you in the app before it applies.
- To the extent permitted by law, FitRats is not liable for indirect or consequential losses, or for money exchanged between members.
7. Ending your use
You can leave a challenge or delete your account at any time. Your past days stay in the group's history unless you delete your account. We may suspend or close accounts that break these terms.
8. Changes to these terms
We may update these terms. Material changes will be announced in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
